Is 100% salary increase under Joint Resolution No. 4 not applicable to devolved health workers? To better understand the controversy on the implementation of salary increase under the law, the following antecedent facts may be reviewed.

Under Republic Act no. 7160, basic health services were devolved to the LGUs, more specifically:

Previous Rules of R.A 7305 not repealed

Did DBM-DOH  Joint Circular no. 1, s. 2012 passed by the Department of Budget and Management and Department of Heath effectively repeal the Revised Implementation Rules and Regulations of R.A 7305? Legally speaking, I don’t think so.

It is because of the expiration of time in passing the rules and regulations on categorization of Magna Carta Benefits under The Total Compensation Framework and the logical absence of intention stated in the said joint circular.

Joint Resolution no. 4 passed by the House of Representatives and the Senate, which was the basis of DBM-DOH Circular no. 1, provides as follows:

What are the effects of R.A 7160 and Joint Resolution no. 4 on R.A 7305? Are the magna carta benefits under R.A 7305 modified or amended by Joint Resolution no. 4 or R.A 7160? How should the Magna Carta provisions be interpreted in case of conflict with other laws or doubt?

These are some of the issues which are circulating in the local government units and local budget officers are showing their proclivity to restrain the implementation of Magna Carta benefits. Their views are focused on the effects of R.A 7160 otherwise known as the Local Government  Code of 1991 and the salary standardization law-the Joint Resolution no. 4 passed by the Philippine Senate and the House of Representatives aside from alleged budgetary constraints.
